2. Financial agreements in family law

Couples can enter into written financial agreements concerning how property is to be divided after separation, before marriage or de facto relationship or during the marriage or relationship. Importantly, an agreement will only be binding if the parties obtain seperate certificates from different legal practitioners stating that their solicitors explained the effect of the financial agreement to them. LME provides clients with quality speciliased advice about finanical agreements, drafts financial agreements, and provides certificates confirming that clients have been advised on the effect of a financial agreement.

Consent orders are an agreement between you and the other party relating to property, which are made in the approved form and submitted to the court for approval. Pre-action procedures PAPS

When couples cannot agree about how property is to be divided after separation they must first follow the PAPS before applying to the court for property orders. Court action
